Man Run Over, Dragged By Truck in The Colony
A construction worker died yesterday when he was run over and dragged by the truck he was repairing.
The vehicle accident happened at 9:30 in the morning at a city pump station on 4100 Main Street in The Colony, Texas. The victim, who remains unidentified, was underneath a truck working on it when another worker got in the truck and drove off.
It appears the worker who drove the truck did not know anyone was underneath it and the incident is being investigated as an accident. No charges have been filed and The Colony Police Department does not anticipate filing any.
The worker who was killed was not employed by the city who owned the pumping station, but instead, contracted out by a construction company to add more lines to the pump station.
Many times, when people call my office, they are confused when I tell them I cannot take their “worker’s comp case” because I don’t go after the employer or co-employees who are liable for accidents. In this instance however, the construction worker’s wrongful death was caused by the negligence of another person (employed by the city).
It can seem very complicated, but the point is, this man’s death was caused by the negligence of a third party and therefore his family has the right to bring a claim for damages on his behalf based on the negligence of the driver. As the driver was employed by the city, the doctrine of Sovereign Immunity will come into play, which limits the amount of compensation one can recover against a governmental entity.
