• A driver is presumed to be intoxicated if his or her Blood Alcohol Content is .08 or above. For a 130 pound person, that means about 2 drinks over a 1 hour period. And for a 200 pound person, that means approximately 3 drinks over a 1 hour time period. Of course, everyone’s metabolism is different and how much you can drink and still be under the legal limit depends on many factors including weight, sex, and how much a person has had to eat.
• Having an open container in the passenger compartment of a car is illegal.
• A driver can refuse a breathalyzer test, but it will result in a license suspension. If a court order is obtained, a driver cannot refuse a blood test.
• In the last year of statistics available, 2007, there were over 88,000 DWI arrests in Texas. Worse that that, there were almost 1,300 fatalities as a result of drunk driving in our state. But the good news is that the fatality number has been decreasing recently, so hopefully all of the public awareness campaigns have had a positive effect by keeping this important issue front and center.
