Myths and Misconceptions About Making a Personal Injury Claim for Compensation

If you have never been seriously injured in an accident before and so never had to consider making hiring a Fort Worth personal injury lawyer to make an insurance claim, you probably have some misconceptions about how the process works and what your legal rights are. Don't worry, you're not alone.

I've addressed some of these myths in the past. For example, making a personal injury claim will not make you rich. A lot of people believe that getting injured in a Fort Worth car wreck and making a PI claim is a profitable get rich quick scheme. That is completely untrue.

Here are some other commonly held misconceptions:

Drunk Driver Hits a Parked Police Car in Fort Worth

Drunk drivers are idiots. I've said it before and I'll say it again.

On Sunday, one such idiot crashed his SUV into a stationary Fort Worth patrol vehicle and was promptly arrested on suspicion of driving while intoxicated. Fortunately, the police officer suffered only slight injuries in the rear-impact crash. The DWI collision occurred at approximately 3:30am on Sunday morning near the intersection of Riverside Drive and Arlington Avenue in east Fort Worth.

More Than 415,000 Crashes in Texas Last Year

Several months ago, TxDOT started broadcasting the latest fatal accident statistics on electronic message boards on roads throughout Texas for one week each month. Although everyone probably noticed them initially, I'll bet that most people now automatically ignore them - just like you do with billboards.

However, as a Dallas-Fort Worth car wreck attorney, I think it's important to understand just how significant an issue traffic collisions are. Although the official detailed TxDOT accident statistics report for 2012 is still months away from release, here are the broad numbers of motor vehicle traffic crashes throughout the state of Texas last year:

A Single Concussion Can Cause Lasting Brain Damage

The month of March is most famous for basketball, but March 2013 is also Brain Injury Awareness Month. As a Texas personal injury lawyer, I know that the effect of a traumatic brain injury (TBI) can have a devastating effect on an accident victim and their family members.

In fact, a recent study has found that serious brain injury can be even more common that most people realize. A study published in the medical journal Radiology has found that permanent brain damage can occur as a result of a single concussion as a result of structural changes to the brain caused by head trauma. However, in many cases the symptom of this brain damage is not evident until long after the fact.

Is it a Travesty That a Hollywood Actress Be Sent to Prison For Causing a Fatal Drunk Driving Accident?

Today was not a very happy Valentine's Day for former Melrose Place actress Amy Locane-Bovenizer as she was sentenced to three years in prison for vehicular manslaughter. Locane, who played Sandy Louise Harling in the early 90s soap, was responsible for the death of 60-year-old Helene Seeman in a 2010 accident which occurred in Montgomery Township, NJ.

Diet Soda Can Make You Drunker

Intoxication results in slower brain functions, gives you a false sense of confidence, and severely impairs your ability to judge speed and distance. As such, mixing alcohol with automobiles is always a very bad idea.

A new study, published by the National Center for Biotechnology Information reminds us just how little we truly already know about how drinking alcohol can actually affect us. As it turns out, drinking a mixed beverage with diet soda as opposed to a full-sugar soda can actually make you significantly drunker. In fact, the study found that participants drinking a liquor and diet coke mixed drink had a Breath Alcohol Concentration 18 percent higher than those who had a drink made full full-calorie soda.

Facial Recognition Technology Seeks to Reduce Distracted Driving

One of the most common arguments I've heard against laws to ban texting while driving is that it is near impossible for police officers to tell whether or not a motorist is actually distracted. After all, what would constitute "distracted driving" in the eye of the law? Would it just be sending text messages while behind the wheel? What about talking on a cellphone? Programming a GPS? Tuning the radio? Talking to kids in the back seat? Smoking a cigarette?

The problem is that there currently is no easy way to prove that a driver was negligently distracted while operating a motor vehicle. It's not like when a cop pulls someone over on suspicion of DWI where they can administer a breathalyzer or blood test to determine if they were over the limit.

NY Jets Coach Causes Multi-Vehicle Crash After Running Red Light

While I'm personally looking forward to the February 3rd Super Bowl XLVII in New Orleans between the San Francisco 49ers and the Baltimore Ravens, I'm sure that at least some of the publicists employed by the NFL must be ready for this season to be over. The last 12 months have seen multiple concussion lawsuits filed against the National Football League, while closer to home there have been two drunk driving wrecks caused by intoxicated Dallas Cowboys players within the past six weeks.

Two Carrollton Police Officers Injured After Drunk Driver Crashes into Their Cars

It's been a bad weekend for drunk driving accidents in North Texas. On Saturday evening, an intoxicated Tarrant County Courtesy Patrol Officer killed a woman when he plowed into her car at a Fort Worth intersection, and on Sunday, a drunk driver crashed into a parked cop car in Carrollton, TX.

Why All Cars Should Come With an Ignition Interlock Device as Standard

As a Dallas-Fort Worth personal injury lawyer, I know that drunk driving is a huge public safety problem in North Texas. You only have to look at the recent New Year's celebrations in DFW to understand that this is a very real problem - one that costs far too many innocent people their lives on an all too regular basis.

While the implementation of mandatory sobriety checkpoints will certainly go some way to reducing the number of DWI fatalities in Dallas-Fort Worth, it's important for everyone to understand that technology already exists which could reduce the number of drunk driving deaths to zero.

New Law and Stiffer Penalties Aim to Crack Down on Uninsured Drivers

As a Fort Worth personal injury lawyer for more than two decades, I have helped tons of people who have been injured in car wrecks caused by uninsured drivers. Unfortunately, despite the fact that minimal liability auto insurance is mandatory in Texas, it is estimated that as many as 25 percent of motorists are uninsured.

Thoughts on the Issue of Gun Control

It has been a week now since the unspeakable horror of the murders at Sandy Hook Elementary School in Newtown, Connecticut. Since then, there has been the predictable media frenzy which now surrounds every tragedy thanks to 24 hour news channels. Much has already been said about this terrible, terrible event. Quite rightly, in my opinion, the question of modifying laws surrounding the public's access to guns has come to the front of the national conscience. As much as it is a difficult discussion, it is a necessary one.

How to Stop Drunk Driving Fatalities in Dallas-Fort Worth

The period between Thanksgiving and New Year's is the worst time of year for drunk driving accidents. A little over a week ago, we were shocked by the news that Dallas Cowboys linebacker Jerry Brown had been killed in a fatal DWI wreck - he was riding a car driven by intoxicated Cowboys nose tackle Josh Brent. This accident made national headlines due to the fact both driver and passenger were NFL athletes. Many such deadly crashes go unreported.
